Hold Harmless and Release

1. Non-clinical service

These notices are effective as of September 16, 2026. They apply to https://hello-i-am-here.com, The Couch, companion care, vibe rooms, listener sits, and related software, copy, audio, and artwork (the "Service"). The operator is Hello. I Am Here.. Questions: info@hello-i-am-here.com.

Hello. I Am Here. provides human listening and encouragement. It is not therapy, counseling, medical care, crisis response, or legal, financial, or clinical advice. Some listeners may have clinical background and/or education, but on this Service they operate only in a non-clinical or peer role. A sit is not therapy or a clinical session. Listeners are not sitting as licensed mental health professionals. You assume the risk of relying on anything said in a sit, companion chat, or resource list.

2. Release

To the fullest extent allowed by law, you release, waive, and forever discharge Hello. I Am Here., its owners, officers, listeners, contractors, and affiliates from any and all claims, damages, losses, and expenses (including attorneys' fees) arising out of or related to: (a) your use of the Service; (b) statements, silences, or omissions by a listener; (c) outcomes of a sit; (d) companion, vibe, or resource content; (e) unavailability of a listener; (f) your decision not to contact 911, 988, or other emergency services; and (g) screenshot, recording, or copy controls that do not stop every device from capturing a screen.

This release does not waive liability for our own willful misconduct or any claim that cannot be waived under applicable law.

3. Hold harmless and indemnity

You agree to defend, indemnify, and hold Hello. I Am Here. harmless from any claim, demand, investigation, or proceeding brought by a third party (including another user, a competitor, a rights holder, or a regulator) that arises from: your content; your recording or sharing of a sit; scraping, cloning, or reverse-engineering the Service; impersonation; misuse of another person's data; or your violation of these notices.

4. Crisis and emergency

If you are in danger, you will contact 911, 988, the Veterans Crisis Line, the National Domestic Violence Hotline, the LGBT National Hotline, The Trevor Project, or local emergency services. The Service is not an emergency dispatch. Failure to seek emergency help is your responsibility.

5. Survival

This Hold Harmless and Release survives termination of your account and remains in force after a sit ends.
